Modifying Child Support

Our lives are constantly changing and there often comes a time to modify the amount of child support that you are paying or receiving.  There are a variety of reasons it may be time to modify your child support order for your children.  

The Texas Family Code recognizes two specific circumstances in which your child support order may be modified.

The first is if there has been a material and substantial change in circumstances for anyone involved.  

Perhaps the other parent has a new job with a higher income and you want to increase their child support obligation.  

Maybe you lost your job and need your child support obligation reduced.

Maybe the other parent relocated and there are increased expenses to see your child.  

These are all examples of changes in circumstances that could justify modifying a child support order.

The second option to modify child support is if the amount of support previously ordered differs by the lesser of 20 percent or $100 from the amount that would currently be ordered under the statutory child support guidelines.
